DriveClub Website Privacy Policy

BlueVolte, Inc., doing business as DriveClub ("DriveClub," "Company," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit driveclub.io; create an Explorer or paid membership account; receive a RIDE Report; interact with Milo; request insurance quotes, repairs, roadside assistance, or other partner services; purchase a product or membership; communicate with us; or otherwise use our websites, applications, products, and services (collectively, the "Services").

This Privacy Policy is incorporated by reference into the DriveClub Terms of Use and Membership Agreement. Our separate AI Privacy Notice supplements this Privacy Policy and provides additional information about personal information processed through Milo and other AI-powered features.

Important: This Privacy Policy notifies you of our practices. Where applicable law requires consent for a particular activity, we will request that consent separately.

1. Scope

This Privacy Policy applies to personal information DriveClub controls in connection with the Services. It does not govern the independent privacy practices of third parties, including repair facilities, insurance providers, roadside assistance providers, payment processors, or other partners whose products or services you choose to use. Those organizations may provide their own privacy notices.

2. Personal Information We Collect

The personal information we collect depends on how you interact with DriveClub. We may collect the categories below. Examples are illustrative and do not mean that we collect every listed item from every person.

3. Sources of Personal Information

We may collect personal information:

  • Directly from you, including when you create an account, enter vehicle information, request a quote or service, communicate with Milo, contact support, or make a purchase.
  • Automatically from your browser, device, cookies, and similar technologies when you use the Services.
  • From service providers and contractors that support payments, analytics, communications, fraud prevention, hosting, AI functionality and other operations.
  • From partners when you request or use their services, including insurance, roadside assistance, vehicle protection and repair-network partners.
  • From public, licensed or otherwise lawfully available vehicle, recall, safety, repair and ownership-information sources.
  • From marketing, referral and affinity partners that direct you to DriveClub, consistent with their notices and your choices.

4. How We Use Personal Information

We may use personal information to:

  • Provide, operate, maintain and improve the Services, memberships, RIDE Reports, Milo and customer support.
  • Create and manage accounts; authenticate users; administer benefits, purchases, billing, renewals and cancellations.
  • Personalize vehicle information, content, recommendations, benefits and offers.
  • Connect you with products or services you request from DriveClub or participating partners.
  • Process transactions, confirm purchases, collect amounts due and maintain transaction records.
  • Communicate about accounts, memberships, requested services, security, policy changes and customer-support matters.
  • Send marketing communications where permitted and honor marketing preferences and opt-outs.
  • Measure and improve Service performance, understand usage, conduct research and analytics, and develop features.
  • Detect, investigate, and prevent fraud, misuse, security incidents, and other harmful or unlawful activity.
  • Comply with legal obligations, enforce agreements, protect rights and safety, and establish or defend legal claims.
  • Support corporate transactions such as financing, mergers, acquisitions, reorganizations, or asset sales.

5. Artificial Intelligence and Milo

DriveClub uses artificial intelligence, including Milo, to answer questions, personalize experiences, recommend products and services, detect fraud, improve customer support and enhance our offerings. When you interact with Milo, DriveClub and service providers acting on our behalf may process prompts, responses, conversation history, account information, vehicle information, and related usage data.

Authorized personnel may review AI interactions for customer support, quality assurance, safety, security, fraud prevention, and legal compliance. We do not use AI alone to make decisions that produce legal or similarly significant effects without appropriate human review. Please do not submit Social Security numbers, driver's license or passport numbers, financial-account credentials, health information or other highly sensitive information unless DriveClub specifically requests it for a transaction or Service.

6. Cookies, Analytics and Advertising

We and our service providers use cookies, pixels, software development kits and similar technologies to operate the Services, remember choices, understand usage, measure performance, prevent fraud and support advertising.

We use analytics services, including Google Analytics, and may use advertising services provided by Google, Meta and other partners. These providers may receive device identifiers, cookie identifiers, IP addresses and internet or usage information. Their use of information may be governed by their own privacy notices.

You may adjust available choices using Cookie Preferences, or the Do Not Sell or Share My Personal Information link on the Site. Browser settings may also block or delete cookies, although some Services may not function properly. A traditional Do Not Track signal is different from a legally recognized opt-out preference signal. Where required by law, we treat Global Privacy Control or another recognized universal opt-out signal as a request to opt out of sale or sharing for the browser or device sending the signal.

7. How We Disclose Personal Information

We may disclose personal information to the following recipients for the purposes described below:

DriveClub does not sell personal information for money. Our use of certain advertising and analytics technologies may be considered a "sale" or "sharing" under some state privacy laws even when no money is exchanged. You may opt out as described in Section 11.

8. Payments

DriveClub uses third-party payment processors, including FluidPay, to process payment information. DriveClub does not store full payment card numbers. Payment processors collect and process payment information on our behalf. We may receive billing information, card type, partial card information, payment tokens, transaction identifiers, payment status, and related records. Payment processors maintain their own privacy and security practices, and payment-card processing is subject to applicable payment-card standards.

9. Data Security

We maintain administrative, technical, and physical safeguards designed to protect personal information. Depending on the circumstances, these safeguards may include encryption in transit, access controls, authentication, logging, monitoring, vendor reviews and least-privilege access practices. No transmission or storage method is completely secure, and we cannot guarantee absolute security.

10. Data Retention

We retain personal information for the periods or according to the criteria described in Section 2. In determining retention, we consider the duration of your account and relationship with DriveClub; the time needed to provide Services and benefits; contractual, accounting, tax and legal obligations; transaction and consent records; dispute-resolution needs; fraud-prevention and security requirements; and whether continued retention is reasonably necessary and proportionate to the purpose for which the information was collected. We may retain deidentified or aggregated information where permitted by law.

11. U.S. State Privacy Rights

Depending on your state of residence and subject to applicable law, you may have the right to:

  • Confirm whether we process your personal information and access or obtain a copy of that information.
  • Request correction of inaccurate personal information.
  • Request deletion of personal information, subject to legal exceptions.
  • Obtain certain information in a portable format.
  • Opt out of the sale of personal information, targeted advertising, or sharing for cross-context behavioral advertising.
  • Limit certain uses and disclosures of sensitive personal information, where that right applies.
  • Opt out of qualifying profiling or automated decision-making, where applicable.
  • Receive equal service and not be discriminated against for exercising a privacy right.
  • Appeal our decision regarding a privacy request where applicable law provides an appeal right.

Submitting a privacy request

To exercise an applicable privacy right, email support@driveclub.io or write to us at the address in Section 16. Describe the right you wish to exercise and provide enough information for us to identify the relevant records. We may request information reasonably necessary to verify your identity and authority. We will use verification information only for verification, fraud-prevention, and compliance purposes.

Where permitted, an authorized agent may submit a request on your behalf. We may require proof of the agent's authority and may ask you to verify your identity directly. Certain information may be exempt from a request, and we may retain information where permitted or required by law. If we deny an appealable request, you may appeal by replying to our decision or emailing support@driveclub.io with "Privacy Appeal" in the subject line.

Sale, sharing and targeted advertising choices

To opt out of disclosures that may be considered a sale or sharing, or of targeted advertising, use Cookie Preferences or the Do Not Sell or Share My Personal Information link on the Site. Where required, we also honor recognized universal opt-out preference signals, including Global Privacy Control, for the browser or device sending the signal. Your cookie-based choice may need to be renewed if you clear cookies, change browsers, or use another device. If you are logged into your account when you make the request, we may also apply the choice to your account where technically feasible and required by law.

Sensitive personal information

We may process account login information and location information that may qualify as sensitive personal information under some laws. We use such information to provide requested Services, authenticate accounts, maintain security, prevent fraud, and comply with law. We do not use sensitive personal information to infer characteristics about you. If our practices change in a way that creates a right to limit use or disclosure, we will provide the required method to exercise that right.

California-specific information

California residents may have the rights described above under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, when that law applies. During the preceding 12 months, DriveClub has collected the categories described in Section 2, disclosed applicable categories for the business purposes described in Section 7, and may have shared identifiers, internet or network activity, approximate location and related inferences with advertising partners for cross-context behavioral advertising. DriveClub does not knowingly sell or share the personal information of consumers under 16 years of age.

California residents may also request information regarding certain disclosures of personal information to third parties for their own direct-marketing purposes under California's Shine the Light law, where applicable, by contacting us as described in Section 16.

12. Marketing Communications

You may unsubscribe from marketing emails by using the unsubscribe link in the message or contacting support@driveclub.io. You may opt out of marketing text messages by replying STOP. These choices do not prevent us from sending nonmarketing communications about your account, transactions, requested services, safety, security, legal notices or other aspects of our ongoing relationship. Consent to receive marketing text messages is not a condition of purchasing goods or services.

13. Children's Privacy

The Services are intended for adults and are not directed to anyone under 18. We do not knowingly collect personal information from anyone under 18. If you believe a person under 18 has provided personal information to DriveClub, contact us at support@driveclub.io so we can investigate and take appropriate action.

14. Third-Party Services and Links

The Services may link to or facilitate access to websites, products and services operated by third parties. When you choose to interact with a third party, that party may independently collect and use personal information under its own privacy notice. DriveClub does not control and is not responsible for third-party privacy practices. We encourage you to review the applicable third-party privacy notice before providing information.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will post the revised version and update the "Last updated" date. If changes are material, we will provide additional notice or obtain consent, as required by applicable law, before the changes take effect.
